Welcome to Luxtex Balloons.

These Terms & Conditions govern your use of our website and the purchase of products from Luxtex Balloons. By accessing our website or placing an order, you agree to be bound by these Terms & Conditions.

If you do not agree with these Terms & Conditions, please do not use our website or purchase our products.

Throughout these Terms, the words "we", "us" and "our" refer to Luxtex Balloons. "You" refers to the customer or website user.

Products

At Luxtex Balloons, we are committed to delivering high-quality balloons with exceptional colour consistency across our range. We work closely with our manufacturing partners and take great care when selecting colours to provide our customers with reliable and consistent products.

While every effort is made to maintain consistency between production batches, latex balloons are manufactured products and slight variations in colour, shade, size or finish may occasionally occur. These variations are uncommon, generally minimal, and do not affect the quality or intended performance of the product.

Product photographs are intended to represent our balloon colours as accurately as possible. However, colours may appear differently depending on individual screen settings, device displays and lighting conditions.

All product availability is subject to stock on hand.

Pricing

All prices displayed on the Luxtex Balloons website are listed in Australian Dollars (AUD) and are exclusive of GST.

GST will be calculated and added at checkout where applicable in accordance with Australian taxation laws.

While we make every effort to ensure pricing is accurate, Luxtex Balloons reserves the right to correct pricing errors, inaccuracies or omissions at any time.

Prices may be updated at any time without prior notice.

Orders

Placing an order does not guarantee acceptance.

Luxtex Balloons reserves the right to refuse, cancel or limit any order where necessary, including but not limited to pricing errors, website errors, suspected fraudulent activity, stock availability or circumstances beyond our reasonable control.

If payment has already been processed for a cancelled order, a full refund will be issued using the original payment method.

Payment

Payment must be received in full before an order is dispatched.

We accept the payment methods displayed during checkout.

All payments are securely processed through Shopify and its approved payment providers. Luxtex Balloons does not store your complete payment card details.

Shipping

Shipping, dispatch times and delivery estimates are outlined in our Shipping Policy.

Risk in the goods passes to the customer once the order has been delivered to the nominated delivery address.

Returns & Refunds

Returns and refunds are governed by our Returns & Refund Policy.

Nothing in these Terms & Conditions limits your rights under the Australian Consumer Law.

Product Safety

Latex balloons are not toys and should always be used responsibly.

Customers are responsible for the safe handling, inflation, installation and use of all products purchased from Luxtex Balloons. Adult supervision is required where balloons are used around children.

Please refer to our Balloon Care, Safety & Sustainability Guide for important information regarding inflation, storage, environmental conditions and general product safety.

Intellectual Property

Unless otherwise stated, all content on this website, including our logo, branding, graphics, product photography, balloon images, text and designs, is the intellectual property of Luxtex Balloons.

We encourage our customers and the balloon styling community to use our balloon product images when creating digital mock-ups, design concepts, client proposals, mood boards and inspiration boards.

You are welcome to use our product images for these purposes without requesting permission.

However, our images may not be:

  • Used to advertise or sell products from another balloon brand.

  • Reproduced or redistributed as standalone images for commercial resale.

  • Altered in a way that misrepresents Luxtex products or branding.

  • Used in any unlawful, deceptive or misleading manner.

Where practical, we appreciate acknowledgement of Luxtex Balloons when our images are used.

All other website content, including our branding, logo and written content, may not be copied, reproduced, modified or distributed without our prior written permission.

Website Use

By using this website, you agree not to:

  • Use the website for any unlawful purpose.

  • Attempt to interfere with the operation or security of the website.

  • Upload malicious software or harmful code.

  • Misuse the website in any way that could negatively affect Luxtex Balloons or other users.

Limitation of Liability

To the maximum extent permitted by Australian law, Luxtex Balloons is not liable for indirect, incidental or consequential loss arising from the use of our products or website.

Our liability is limited to the remedies available under the Australian Consumer Law.

Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law.

Luxtex Balloons may update these Terms & Conditions from time to time.

Any changes will take effect immediately upon publication on this website.

Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

Any disputes arising in connection with these Terms & Conditions shall be subject to the jurisdiction of the courts of New South Wales.
